This Privacy Policy explains how Implicit Media LLC ("Implicit Media," "we," "us," or "our") collects, uses, discloses, and safeguards information across everything we operate: our marketing website at implicitmedia.com (the "Site"), our web application and APIs, and the Implicit Player (together with the Site, the "Services").
Implicit Media provides a business-to-business platform for generating, deploying, and managing video for large-format displays and digital signage. This policy governs how we handle data. Your use of the platform is separately governed by our Terms of Service. Where an organization (a "Tenant") uses the Services, that organization configures and controls its own use, and its privacy practices may also apply; for much of the information processed on the platform, the Tenant is the controller and Implicit Media acts on its behalf.
1. Information We Collect
1.1 Information you provide to us.
- Contact and sales information — when you email us or use a contact link on the Site, we receive your email address and whatever you include in your message (such as your name, organization, and inquiry).
- Account and profile information — name, work email address, organization name, role, and credentials used to register and access an Account on the platform.
- Billing information — subscription plan, billing contact, and transaction history. Payment card details are collected and processed directly by our payment processor (Stripe, Inc.); we do not store full card numbers on our systems.
- Customer Inputs — text, prompts, images, video, audio, brand guidelines, logos, and configuration data that you or your Authorized Users submit to the platform.
1.2 Information we collect automatically.
- Usage and telemetry data — actions taken in the web application, generation and render events, and, from the Implicit Player, playback events, integrity checks, license-validation signals, and aggregate usage metrics.
- Device and log data — IP address, browser type, operating system, referring pages, and timestamps, collected through server logs and similar technologies across the Site and platform.
- Cookies and similar technologies — as described in Section 5.
1.3 Information from third parties.
- Payment processor — Stripe provides us with transaction status, billing metadata, and fraud signals, but not full payment card numbers.
- Authentication and infrastructure providers — limited technical information necessary to authenticate users and operate the Services securely.
2. How We Use Information
We use the information we collect to:
- respond to your inquiries and communicate with you;
- provide, operate, maintain, secure, and improve the Services;
- produce Generated Content in response to Customer Inputs;
- authenticate users and secure Accounts;
- process payments, manage subscriptions, and send billing communications;
- monitor usage, enforce our Terms of Service, detect and prevent fraud and abuse, and validate license compliance;
- analyze aggregate, non-identifying traffic and usage patterns;
- comply with legal obligations and enforce our agreements; and
- with your consent where required, send marketing communications about our products and services.
3. Customer Inputs and AI Training
We do not use Customer Inputs to train general-purpose machine-learning models offered to other customers. We may use Customer Inputs to fine-tune models or generate outputs solely for your own Account, and we may use aggregated or de-identified data derived from operation of the Services in a way that does not identify you or your organization. This is consistent with our Terms of Service.
4. How We Share Information
We do not sell personal information. We share information only as described below:
- Service providers and subprocessors — we share information with vendors who perform services on our behalf, including cloud hosting and infrastructure (Google Cloud Platform), payment processing (Stripe, Inc.), and the third-party machine-learning model providers and infrastructure used to produce Generated Content. These providers are authorized to use information only as necessary to provide services to us.
- Within your organization — activity on the platform may be visible to your organization's administrators and other Authorized Users of the same Tenant.
- Legal and safety — we may disclose information if required by law, regulation, legal process, or governmental request, or where we believe in good faith that disclosure is necessary to protect the rights, property, or safety of Implicit Media, our customers, or others.
- Business transfers — in connection with a merger, acquisition, financing, or sale of all or substantially all of our assets, information may be transferred as part of that transaction, subject to this Privacy Policy.
5. Cookies and Analytics
Our marketing Site is largely static and does not use cookies to track you across other websites or for advertising. On our web application, we use cookies and similar technologies to keep you signed in, remember preferences, and secure the Services. Site pages also load web fonts served by Google Fonts, which may cause Google to receive your IP address and standard request data. You can control cookies through your browser settings; disabling some may affect functionality. Where required by applicable law, we will request your consent before setting non-essential cookies, and if we add analytics tooling we will update this policy to name the provider.
6. Data Retention
We retain personal information for as long as necessary to provide the Services, respond to inquiries, comply with our legal obligations, resolve disputes, and enforce our agreements. Email correspondence and server-log data are retained in the ordinary course of operating and securing the Services.
Following termination or expiration of a subscription, we retain Generated Content and Customer Inputs associated with the Account for a ninety (90) day window in an inaccessible state, after which they are permanently deleted, subject to any retention required by applicable law or by our reasonable backup and disaster-recovery practices. This mirrors the data-retention provisions of our Terms of Service.
7. Security
We use commercially reasonable administrative, technical, and organizational measures designed to protect information against unauthorized access, disclosure, alteration, and destruction. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If you believe your Account has been compromised, contact us immediately at security@implicitmedia.com.
8. Your Rights and Choices
Depending on where you live, you may have rights regarding your personal information, including the right to access, correct, delete, or port your information, and to object to or restrict certain processing.
- California residents — under the CCPA/CPRA, you may request access to or deletion of personal information and may correct inaccurate information. We do not sell or share personal information for cross-context behavioral advertising.
- EEA and UK residents — under the GDPR and UK GDPR, you may exercise the rights described above and lodge a complaint with your supervisory authority. Our legal bases for processing include performance of a contract, our legitimate interests in operating and securing the Services, compliance with legal obligations, and consent where applicable.
Because much of the information processed on the platform is provided by a Tenant organization, we may direct certain requests to that organization as the controller of the information, or ask you to submit your request through it. 9. International Data Transfers
We are based in the United States and process information there and in other countries where we or our service providers operate. Where we transfer personal information across borders, we take steps to ensure it receives an adequate level of protection as required by applicable law.
10. Children's Privacy
The Services are intended for business use and are not directed to individuals under eighteen (18) years of age. We do not knowingly collect personal information from children. If you believe a child has provided us personal information, contact us and we will take appropriate steps to delete it.
11. Third-Party Links
The Services may link to third-party websites and services that we do not control. This Privacy Policy does not apply to those third parties, and we encourage you to review their privacy policies.
12. Changes to This Policy
We may update this Privacy Policy from time to time. The "Last Updated" date at the top reflects the most recent revision. Material changes will be communicated as required by applicable law. Your continued use of the Services after an update becomes effective constitutes acceptance of the revised policy.
